Terms of Use
Please read these terms carefully before using any services provided by KOKYO Travel Inc. Your access or use of our services constitutes acceptance of these terms.
These Terms of Use ("this Agreement") govern the services ("Service") provided within KOKYO Tours (https://kokyo-tours.com) by KOKYO Travel Inc. ("the Company") and may be revised as needed. Once accessed, read, used, or registered, customers are deemed to have read and understood the terms below.
01 About This Service
This Service allows the customer (including companions) to search for tourist attractions, accommodations, restaurants, activities, hotels, transportation, temples, art museums, and museums that fit their travel itinerary through the Company's websites ("Search Service").
Based on Article 5, registered users may use paid services including labor contract services for restaurants and activities, reservation tools, platform services, and other related services ("Restaurant Reservation Agency Service"), as well as other services provided free of charge to registered users.
When a customer wishes to make a reservation for an accommodation found through the Search Service, they must contact the accommodation provider ("Accommodation Provider") directly and enter into a contract with the Accommodation Provider without involving the Company.
The Reservation Agency Service facilitates direct contracts between registered users and restaurants; the Company is not a party to such contracts. The Company does not charge any reservation fees or mediation fees for use of the Search Service.
02 Application
This Agreement establishes the conditions under which the Service is provided and governs the rights and obligations between the Company and its customers. It applies to all relationships between the customer, the Service, and the Company.
Some parts of the Service may have separately determined Terms of Use, usage guidelines, and policies. Unless stated otherwise in this Agreement, this Agreement takes precedence over any differing terms or guidelines.
03 Purpose
This Service is intended solely for personal, non-commercial use by the customer. Use of the Service for business activities or commercial profit is prohibited without prior consent from the Company.
04 Usage Facilities
An accessible network connection is required to use this Service. Customers are responsible for preparing and bearing the cost of all necessary software and web facilities. The Company accepts no responsibility for any expenses or preparation methods.
05 Registration
Persons wishing to use the Reservation Agency Service may register by submitting the required information to the Company through its designated method. The Company will evaluate each application according to its own criteria and notify accepted applicants; registration is finalized upon that notification.
The Company may refuse or rescind registration without disclosing its reasons if any of the following apply:
- The registration information contains falsehoods, errors, or omissions.
- The applicant is a minor, adult ward, or person under conservatorship without required consent from a legal representative, guardian, or conservator.
- The Company determines the applicant is, or is associated with, an antisocial force (including gangs, organized crime groups, right-wing organizations, or similar entities).
- The Company determines the applicant has previously violated an agreement with the Company.
- Measures under Article 15 have been applied to the applicant.
- Any other case where the Company deems registration unsuitable.
06 Changes to Registration Information
If any registered information changes, the registered user must promptly notify the Company through the designated method.
07 Password and User ID Management
Registered users are solely responsible for the appropriate management of their user ID and password and must not allow any third party to use, lend, transfer, rename, buy, or sell their account. The Company accepts no responsibility for any damage caused by insufficient account management or unauthorized third-party use.
08 Email Notifications
KOKYO Travel Inc. will send customers service-related emails (such as signup confirmations, booking information, and booking status updates) as well as commercial communications upon acceptance and confirmation of the customer's registration.
09 Rates and Payment
Registered users must pay the fees displayed on our website via the payment methods specified by the Company. If an incorrect price is displayed and confirmed by the Company, the Company will correct it and notify the customer by email of the correct pricing and any resulting order cancellation.
10 Intellectual Property Rights
All intellectual property rights in the content, information, itineraries, trademarks, images, animations, advertisements, and designs included in this Service belong to their respective copyright holders. Software used in connection with this Service is protected by applicable intellectual property laws.
Customers may not edit, modify, publish, reproduce, publicly transmit, distribute, sell, translate, or otherwise use the Service's content without prior consent from the Company or the relevant rights holders. The Company reserves the right to seek compensation equivalent to any profits derived from unauthorized use.
11 Copyrights on Posted Content
By posting content (including text, photos, and videos) to this Service, the customer grants the Company rights of public transmission, distribution, translation, and copyright use of that content.
The customer warrants that all posted content does not infringe upon any third party's rights. The Company or licensed third parties may use posted content in modified forms (e.g., summaries, resizing, cropping), and may attribute the content to the customer's nickname. Neither the Company nor any third party will compensate for damages arising from the use of posted content.
12 Disclaimers
This Service is used at the customer's own judgment and responsibility. The Company accepts no responsibility for the following:
- Damages caused by the availability or unavailability of any information provided by this Service.
- Damages resulting from false information in this Service, except where attributable to the Company's own liability.
- Damages arising from broken links, outdated information, or other circumstances beyond the Company's control.
- The accuracy, currency, completeness, or suitability of information displayed in search results or on Accommodation Provider websites.
- The success or failure of reservations or contracts between customers and Accommodation Providers.
- The accuracy of advertisements or external links, which are used at the customer's own risk.
Customers must verify information directly with the Accommodation Provider and are responsible for reading and understanding the provider's own terms before making reservations or entering contracts.
13 Prohibited Actions
The following actions are strictly prohibited:
- Actions that violate laws, regulations, or constitute criminal acts.
- Fraud or threats directed at the Company or other users.
- Actions contrary to public order and morals, or any violation of this Agreement.
- Infringement of intellectual property rights (copyright, trademarks, patents, know-how, etc.) of the Company, other users, or third parties.
- Unauthorized copying, reproduction, transmission, distribution, resale, or modification of any Service content.
- Actions that damage the Company's or the Service's reputation, or that place excessive burden on the Service's systems.
- Unauthorized access to the Company's network or systems, or impersonation of a third party.
- Unauthorized commercial activities on the Service, including advertising or collection of other users' information.
- Payments or benefits to antisocial forces, or any facilitation thereof.
- Any other actions the Company determines to be inappropriate.
The following types of reviews and images are also prohibited and may be removed without notice:
- Content that is unverifiable, illegal, defamatory, or in breach of an Accommodation Provider's terms.
- Content related to personal disputes, criminal acts, privacy violations, or copyright infringement.
- Obscene, violent, politically charged, or commercially motivated content.
- Images for which the Accommodation Provider has not given permission.
14 Age Restrictions
Some services within KOKYO Tours may only be available to customers who meet applicable age requirements.
15 Service Suspension
The Company may suspend or terminate part or all of the Service without prior notice in the following circumstances:
- Urgent maintenance or inspection of computer systems.
- Disruption of communication circuits.
- Unavoidable events such as earthquakes, lightning, fire, flooding, power outages, or other natural disasters.
- Any other case where the Company deems suspension or termination necessary.
The Company accepts no responsibility for any damage that registered users may incur as a result of such measures.
16 Account Termination
The Company may delete posted data or suspend Service access without prior notice if any of the following apply:
- Violation of any provision of this Agreement, or discovery of falsified registration information.
- Payment suspension, insolvency, or commencement of civil rehabilitation or corporate reorganization proceedings.
- No use of the Service for more than one year.
- No response to the Company's inquiries within 30 days.
- Correspondence to Article 5, Clause 4, or any other case where the Company deems continuation unsuitable.
Upon termination, all outstanding debts become immediately due and payable in full. The Company accepts no responsibility for any damage arising from such measures.
17 Withdrawal
Registered users may withdraw from the Service at any time by notifying the Company through the designated method. Any outstanding debts at the time of withdrawal become immediately due and payable in full. The Company's Privacy Policy continues to apply after withdrawal.
18 Deletion of Reviews and Photos
To ensure a comfortable experience for all users, the Company may delete the following content without notice, at its sole discretion:
- Content that violates this Agreement or public order and morals.
- Content unrelated to this Service, accommodations, or providers.
- Content containing harmful programs or scripts.
- Advertising or content related to personal commercial transactions.
- Content the Company determines to be disruptive to service administration.
19 Changes to Service Content
The Company may change, suspend, or terminate the Service (including any content offered within it) without prior notice. The Company accepts no responsibility for any damage the customer incurs as a result.
20 Use of Information
The Company may use information obtained through the Service — including stay evaluations, pricing data, and related information — and share such data with third parties in aggregated, anonymized forms that do not identify any individual or corporation.
21 Severability
If any provision or part of this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
22 Governing Law and Jurisdiction
This Agreement is governed by the laws of Japan. The Tokyo District Court shall serve as the exclusive court of first instance for any disputes arising in connection with this Agreement.
23 Language
This Agreement is established in Japanese. Any English or other language translations are provided for reference only and shall not be binding upon either the customer or the Company.
24 Communications
The Company will communicate with customers through its website, email, post, or telephone, using its designated communication methods.
